  1. Introduction

These Terms and Conditions (“Agreement”) set forth the legally binding terms between On the Go Courier (“Company”, “we”, “our”, “us”) and the customer or user (“you”, “your”, “client”) for the access and use of our shipping, courier, and related logistics services through our website, mobile application, or any other channel.

By accessing or using any of our services, you agree to comply with these Terms. If you do not agree, please do not use our services.

  1. Definitions
  • Shipment: Any document, package, parcel, or item delivered via On the Go Courier services.
  • Consignee: The person to whom the shipment is addressed or delivered.
  • Sender/Shipper: The person or entity sending the shipment.
  • Prohibited Items: Any goods which are restricted by law or under our shipping policy.
  • Business Day: Monday to Friday, excluding public holidays.
  1. Scope of Services

We provide the following services, which may evolve over time:

  • Local courier pickups and deliveries
  • Regional and international shipping and logistics
  • Real-time tracking and updates
  • Package forwarding and storage services
  • Express, scheduled, and custom delivery solutions
  • E-commerce integrations and last-mile delivery support

We reserve the right to refuse service to any package, person, or address without obligation to disclose reasons.

  1. User Responsibilities

As a user, you agree to:

  • Provide truthful, complete, and up-to-date shipment information.
  • Properly pack and secure shipments to prevent damage.
  • Ensure shipment contents are lawful and permitted for transport.
  • Pay all applicable charges including customs duties and service fees.
  • Comply with import/export laws, customs regulations, and international treaties.

You are solely responsible for the accuracy of all shipment details including recipient information, contents, dimensions, and declared value.

  1. Shipment Conditions
  • Packaging: All items must be securely packed to ensure protection during transit. Fragile or high-value items must be specially protected or marked.
  • Labeling: Each shipment must include the correct and complete recipient address, phone number, and sender details.
  • Weight & Dimensions: Misreported weight or dimensions may result in extra charges or refusal of service.

We may re-weigh and re-measure any shipment to confirm accuracy.

  1. Prohibited and Restricted Items

You agree not to ship items that fall under the following categories (this list is not exhaustive):

  • Flammable, hazardous, or toxic materials
  • Weapons, ammunition, explosives
  • Narcotics and controlled substances
  • Cash, bearer instruments, or other forms of untraceable value
  • Perishable foods without proper refrigeration
  • Live animals or plants
  • Pornographic or obscene materials
  • Counterfeit, pirated, or stolen goods
  • Items prohibited under Jamaican or international law

On the Go Courier reserves the right to open and inspect packages suspected of containing prohibited items and to cooperate with law enforcement when necessary.

  1. Delivery Policy
  • Delivery Window: Estimated delivery times are approximate and not guaranteed unless explicitly stated in a written service-level agreement.
  • Attempted Delivery: If the recipient is unavailable, we may attempt delivery at a later time, deliver to an alternate address, or return the shipment to sender. Additional charges may apply.
  • Signature and Proof: Deliveries may require a signature, photo confirmation, or digital acknowledgment as proof of receipt.

We will not be responsible for delays caused by incorrect address, customs issues, force majeure, or acts outside our control.

  1. Payment Terms
  • All charges, including base rate, surcharges, duties, taxes, and additional services, must be paid in full prior to or upon service execution unless otherwise agreed.
  • Accepted payment methods: Cash, Credit/Debit Card, Bank Transfer, or Mobile Wallets.
  • Outstanding payments beyond [Insert Days] days may attract late fees and service suspension.

We reserve the right to revise our pricing and will notify users of significant changes through the website or registered email.

  1. Customs and International Shipping

For international shipments:

  • Duties and Taxes: Recipients are responsible for all import duties, customs fees, and any applicable taxes.
  • Documentation: All required documents (invoices, licenses, etc.) must be provided at the time of shipping.
  • Delays: Customs clearance delays are outside our control and do not constitute grounds for refunds.

You acknowledge that customs authorities have the right to inspect, open, and delay any shipment at their discretion.

  1. Insurance and Liability
  • Basic Liability: In the event of proven loss or damage caused by us, our liability is limited to [insert amount or e.g. JMD$2,000 or declared item value—whichever is less].
  • Optional Insurance: Clients may purchase additional insurance for high-value goods. Terms and coverage vary.
  • Exclusions: We are not liable for:
    • Consequential or indirect damages (e.g. business losses)
    • Damage due to inadequate packaging
    • Losses caused by customs seizure or delay
    • Force majeure events (weather, acts of God, political unrest, etc.)

Claims must be submitted in writing within 7 calendar days from the date of delivery or the expected delivery date.

  1. Refund Policy

Refunds may be issued under the following circumstances:

  • Package not delivered due to proven fault by On the Go Courier
  • Overpayment or billing errors
  • Canceled services prior to dispatch or pickup

Refunds will not be issued for:

  • Delays caused by weather, customs, or third-party carriers
  • Improperly packed or prohibited items
  • Client-provided wrong information

Refund requests must be submitted via email or our support portal within 10 days of the service date.

  1. Tracking and Notifications

We provide tracking numbers for each shipment. You are responsible for monitoring your package and reporting any issues.

Our system sends automated updates via email, SMS, or in-app alerts. You agree to receive these notifications.

  1. User Accounts and Website Use
  • You may be required to register for an online account to access certain features.
  • You agree to safeguard your login credentials and not share your account.
  • You are liable for all actions conducted under your account.

Misuse of the website (e.g., hacking, data scraping, impersonation) is strictly prohibited.

  1. Intellectual Property

All content, graphics, logos, and technology on our website or mobile app are owned by On the Go Courier or its licensors. Use of these materials without written permission is strictly prohibited.

  1. Service Modifications

We reserve the right to modify, suspend, or discontinue any part of the service at any time without prior notice. We are not liable to you or any third party for such changes.

  1. Termination

We may suspend or terminate service to any user for reasons including but not limited to:

  • Violation of these terms
  • Abuse of service or staff
  • Fraudulent activity
  • Non-payment or repeated late payments

In the event of termination, outstanding obligations still apply.

  1. Force Majeure

We are not liable for failure or delay in performance caused by events beyond our reasonable control, including but not limited to natural disasters, war, labor strikes, governmental action, or disruptions in communication systems.

  1. Governing Law and Jurisdiction

These Terms are governed by and interpreted in accordance with the laws of Jamaica. Disputes arising under these Terms shall be resolved in Jamaican courts, unless otherwise stated in a separate contract.

  1. Dispute Resolution

Before resorting to legal action, both parties agree to attempt to resolve any dispute amicably through negotiation. If unresolved, disputes shall be referred to arbitration or small claims court in accordance with Jamaican law.

  1. Severability

If any provision of these Terms is deemed invalid, illegal, or unenforceable, the remaining provisions shall remain in full force and effect.

  1. Updates to Terms

These Terms and Conditions may be updated periodically. When we make changes, we will revise the “Effective Date” and may notify users via email or the website. Continued use of the service after changes constitutes acceptance.
